This Agreement (the "Agreement") is made between PSYCAN MANOVAHA PVT. LTD., having its registered office at B-33/34, Krishna Puram Behind Birla Mandir, Mathura, Uttar Pradesh, 281003, hereinafter referred to as "PsyCan" or "We" (which expression shall, unless the context otherwise requires, include its affiliates, subsidiaries, successors, and assigns) and the user ("Client" or "You").

1. ACCEPTANCE OF TERMS
By accessing, using, or registering with PsyCan’s platform (the "Platform"), you agree to comply with and be bound by the terms and conditions outlined in this Agreement, as well as our Privacy Policy, the conditions of use, and other applicable policies available at here
. If you do not agree to be bound by this Agreement, you must not access or use the Platform.

2. NATURE OF SERVICES
PsyCan operates an online platform providing psychiatric consultations, online counseling, and psychological therapy services (the "Services"). These Services are provided by independent practitioners, and PsyCan merely facilitates access to their services.

3. USER OBLIGATIONS
By using the Platform, you agree to:

  • Provide accurate and truthful information at the time of registration and during the course of your interaction with the Platform;
  • Comply with all applicable laws, rules, and regulations while accessing or using the Services;
  • Maintain the confidentiality of your account and login credentials, and notify PsyCan immediately of any unauthorized use of your account.

4. SERVICES PROVIDED
PsyCan provides the following Services:

  • Psychiatric Consultations: Provided by certified and licensed psychiatrists.
  • Online Counseling: Conducted by qualified therapists and counselors.
  • Therapy Sessions: Available via video call, audio call, and text-based consultations.

5. INDEPENDENT PROVIDERS
The practitioners available through the Platform are independent providers. They are not employees or agents of PsyCan. The responsibility for the quality and performance of the services provided by practitioners rests solely with the individual practitioners.

6. CLIENT’S RIGHT TO SELECT PRACTITIONERS
Clients have the right to select and book sessions with practitioners based on their needs, including preferences for experience, specialization, language, gender, and fees.

7. AVAILABILITY OF PRACTITIONERS
PsyCan does not guarantee the continuous availability of any practitioner. In case a practitioner is unavailable or decides to cease using the Platform, PsyCan will notify the client and offer an opportunity to choose another practitioner.

8. LIMITATIONS OF PRACTITIONER SERVICES
You acknowledge that the services provided by the practitioners through the Platform are not a substitute for in-person medical treatment or emergency mental health care. In certain cases, in-person therapy may be required, such as for severe mental health conditions like active substance withdrawal or anorexia nervosa.

9. CONSULTATION AND SESSION DETAILS

  • Duration: Psychiatric consultations typically last 25-30 minutes, while therapy sessions last 45-60 minutes. There is a 10-minute waiting period for both clients and practitioners before the session is automatically terminated if not initiated.
  • Modes of Consultation: Consultations will be conducted via video calls, audio calls, or text messaging.

10. FEES AND PAYMENT

  • Fees for consultations and therapy sessions will be determined by the individual practitioners. PsyCan facilitates payment processing through the Platform.
  • Clients agree to pay the fees as specified during the booking of services.

11. CLIENT CONDUCT AND CONFIDENTIALITY
You agree not to:

  • Solicit or request personal information from practitioners outside of the platform (e.g., phone numbers, email addresses, or personal locations);
  • Record or share any session or consultation without prior consent;
  • Disclose or misuse any confidential information obtained during the session.

12. RECORDING OF SESSIONS
Sessions may be recorded by PsyCan for legal, security, and quality assurance purposes. Recordings will be stored securely for a minimum of six months. Clients may refuse consent for recording; however, this may impact their ability to file complaints or take legal action against practitioners.

13. CANCELLATION, NO-SHOW, AND RESCHEDULING POLICY

  • Client No-Show: If a client fails to attend a scheduled session, the practitioner may cancel the session and is entitled to charge the full fee. Clients may be eligible for a 50% discount on their next session if an emergency causes the no-show.
  • Practitioner No-Show: If a practitioner fails to attend a session, the client may request a refund, reschedule, or opt for another practitioner. The practitioner may be held liable for any associated costs.
  • Cancellations will be considered only if the request is made within 2-3 days of placing the order. However, the cancellation request may not be entertained if the orders have been communicated to the vendors/merchants and they have initiated the process of shipping them.
  • PsyCan does not accept cancellation requests for perishable items like flowers, eatables etc. However, refund/replacement can be made if the customer establishes that the quality of product delivered is not good.
  • In case of receipt of damaged or defective items please report the same to our Customer Service team. The request will, however, be entertained once the merchant has checked and determined the same at his own end. This should be reported within 2-3 days of receipt of the products.
  • In case you feel that the product received is not as shown on the site or as per your expectations, you must bring it to the notice of our customer service within 2-3 days of receiving the product. The Customer Service Team after looking into your complaint will take an appropriate decision.
  • In case of complaints regarding products that come with a warranty from manufacturers, please refer the issue to them.
  • In case of any Refunds approved by the PSYCAN MANOVAHA PRIVATE LIMITED, it’ll take 3-4 days for the refund to be processed to the end customer.

14. ACCOUNT SECURITY AND LIABILITY
Clients are responsible for maintaining the confidentiality of their account credentials. PsyCan shall not be liable for any damages arising from unauthorized use of client accounts. Clients must notify PsyCan immediately if they suspect any unauthorized access to their account.

15. EMERGENCY SITUATIONS
PsyCan’s platform is not designed for handling emergency mental health situations. In case of suicidal thoughts, self-harm, or harm to others, clients should immediately contact local emergency services or helplines such as:

16. PRIVACY POLICY AND DATA COLLECTION
PsyCan collects personal data to provide services and improve user experience. All data is stored securely, and clients have the right to access, correct, or delete their personal information. PsyCan complies with applicable data protection laws and employs encrypted technologies to safeguard user data.

17. INTELLECTUAL PROPERTY
All content available on the Platform, including text, images, logos, and trademarks, is the property of PsyCan and is protected under Indian intellectual property laws.

18. INDEMNIFICATION
Clients agree to indemnify and hold PsyCan harmless from any claims, liabilities, or damages arising out of their use of the services or any violation of these terms.

19. LIMITATION OF LIABILITY
PsyCan's liability is limited to providing access to the services offered by independent practitioners. PsyCan is not responsible for the content, quality, or outcomes of the consultations or therapy sessions.

20. AMENDMENTS TO TERMS
PsyCan reserves the right to modify these Terms and Conditions at any time. Any changes will be communicated to clients, and continued use of the Platform after such modifications constitutes acceptance of the revised Terms.

21. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts in Mathura, Uttar Pradesh.

22. MISCELLANEOUS

  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • These Terms represent the entire understanding between the parties and supersede all prior discussions and agreements regarding the subject matter.
