This Agreement (the "Agreement") is made between PSYCAN MANOVAHA PVT. LTD., having its registered office at B-33/34, Krishna Puram Behind Birla Mandir, Mathura, Uttar Pradesh, 281003, hereinafter referred to as "PsyCan" or "We" (which expression shall, unless the context otherwise requires, include its affiliates, subsidiaries, successors, and assigns) and the user ("Client" or "You").
1. ACCEPTANCE OF TERMS
By accessing, using, or registering with PsyCan’s platform (the
"Platform"), you agree to comply with and be bound by the terms and
conditions outlined in this Agreement, as well as our Privacy Policy, the
conditions of use, and other applicable policies available at here. If you do not agree to be bound by this Agreement, you must
not access or use the Platform.
2. NATURE OF SERVICES
PsyCan operates an online platform providing psychiatric consultations, online
counseling, and psychological therapy services (the "Services").
These Services are provided by independent practitioners, and PsyCan merely
facilitates access to their services.

5. INDEPENDENT PROVIDERS
The practitioners available through the Platform are independent providers.
They are not employees or agents of PsyCan. The responsibility for the quality
and performance of the services provided by practitioners rests solely with the
individual practitioners.
6. CLIENT’S RIGHT TO SELECT
PRACTITIONERS
Clients have the right to select and book sessions with practitioners based on
their needs, including preferences for experience, specialization, language,
gender, and fees.
7. AVAILABILITY OF PRACTITIONERS
PsyCan does not guarantee the continuous availability of any practitioner. In
case a practitioner is unavailable or decides to cease using the Platform,
PsyCan will notify the client and offer an opportunity to choose another
practitioner.
8. LIMITATIONS OF PRACTITIONER SERVICES
You acknowledge that the services provided by the practitioners through the
Platform are not a substitute for in-person medical treatment or emergency
mental health care. In certain cases, in-person therapy may be required, such
as for severe mental health conditions like active substance withdrawal or
anorexia nervosa.

12. RECORDING OF SESSIONS
Sessions may be recorded by PsyCan for legal, security, and quality assurance
purposes. Recordings will be stored securely for a minimum of six months.
Clients may refuse consent for recording; however, this may impact their
ability to file complaints or take legal action against practitioners.
13. CANCELLATION, NO-SHOW, AND RESCHEDULING POLICY
14. ACCOUNT SECURITY AND LIABILITY
Clients are responsible for maintaining the confidentiality of their account
credentials. PsyCan shall not be liable for any damages arising from
unauthorized use of client accounts. Clients must notify PsyCan immediately if
they suspect any unauthorized access to their account.
15. EMERGENCY SITUATIONS
PsyCan’s platform is not designed for handling emergency mental health
situations. In case of suicidal thoughts, self-harm, or harm to others, clients
should immediately contact local emergency services or helplines such as:
16. PRIVACY POLICY AND DATA COLLECTION
PsyCan collects personal data to provide services and improve user experience.
All data is stored securely, and clients have the right to access, correct, or
delete their personal information. PsyCan complies with applicable data
protection laws and employs encrypted technologies to safeguard user data.
17. INTELLECTUAL PROPERTY
All content available on the Platform, including text, images, logos, and
trademarks, is the property of PsyCan and is protected under Indian
intellectual property laws.
18. INDEMNIFICATION
Clients agree to indemnify and hold PsyCan harmless from any claims,
liabilities, or damages arising out of their use of the services or any
violation of these terms.
19. LIMITATION OF LIABILITY
PsyCan's liability is limited to providing access to the services offered by
independent practitioners. PsyCan is not responsible for the content, quality,
or outcomes of the consultations or therapy sessions.
20. AMENDMENTS TO TERMS
PsyCan reserves the right to modify these Terms and Conditions at any time. Any
changes will be communicated to clients, and continued use of the Platform
after such modifications constitutes acceptance of the revised Terms.
21. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of
India. Any disputes arising out of or relating to this Agreement shall be
subject to the exclusive jurisdiction of the courts in Mathura, Uttar Pradesh.
